Welcome to Livuma. These Terms of Service ("Terms") govern your use of our website, services, and applications (collectively, the "Platform"). By accessing or using our Platform, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Platform.
1. Acceptance of Terms
By creating an account, accessing, or using our Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy and Cookie Policy, which are incorporated by reference.
We may update these Terms from time to time. Your continued use of the Platform after such changes constitutes your acceptance of the new Terms. It is your responsibility to review these Terms periodically.
2. Platform Access and Accounts
Account Registration
To use certain features of the Platform, you must create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
Age Restrictions
You must be at least 18 years old to create an account and use our Platform. By using our Platform, you represent and warrant that you meet this age requirement.
3. Platform Rules and Restrictions
When using our Platform, you agree not to:
Violate any applicable laws or regulations
Infringe on the rights of others, including intellectual property rights
Post false, inaccurate, misleading, deceptive, defamatory, or offensive content
Use the Platform for any illegal or unauthorized purpose
Attempt to gain unauthorized access to any portion of the Platform
Interfere with or disrupt the integrity or performance of the Platform
Harvest or collect information about other users without their consent
Create multiple accounts or transfer your account to someone else
We reserve the right to remove any content and suspend or terminate accounts that violate these rules.
4. Listings and Inquiries
For Hosts
As a host, you are responsible for:
Providing accurate, complete information about your property
Setting fair and transparent pricing and terms
Ensuring your property meets applicable safety, health, and legal requirements
Ensuring your property listing complies with all local property laws and regulations
Verifying that you have proper legal rights and licenses to list and rent the property
Accurately representing the condition and amenities of your property
Responding to booking requests and guest inquiries in a timely manner
Honoring confirmed bookings unless exceptional circumstances arise
Providing valid payment account information to receive payouts
Complying with tax obligations related to rental income and platform commissions
Honoring cancellation policies and refund obligations
For Guests
As a guest, you are responsible for:
Providing accurate personal information
Communicating respectfully with hosts
Using properties as agreed and respecting property rules
Leaving properties in the condition you found them
Reporting any issues promptly to the host and to Livuma
5. Platform Role as Intermediary
Livuma functions solely as an intermediary platform that connects property owners/managers with potential tenants. We explicitly:
Do not act as a real estate agency, property manager, or broker
Do not verify property ownership status or legal standing
Do not guarantee the accuracy of listings or their compliance with local laws
Do not provide legal advice regarding property transactions or rental agreements
Do not take responsibility for the legal status of foreign-owned properties in Indonesia
Do not monitor or enforce compliance with local licensing requirements for tourist accommodations
Indonesian Property Laws
Users must be aware that Indonesia has specific regulations regarding property ownership, especially for foreign nationals:
Foreign nationals cannot directly own freehold property in Indonesia (Hak Milik)
Various ownership structures exist that may involve leasehold rights (Hak Sewa, Hak Pakai, Hak Guna Bangunan)
Certain "nominee arrangements" may be legally questionable or invalid
Short-term rentals require valid permits (NIB, Pondok Wisata Registration, or Hotel/Villa Operator License)
Property owners are solely responsible for ensuring their listings comply with all applicable laws. Guests are advised to perform their own due diligence regarding the legal status of properties they book.
Livuma reserves the right to remove any listings that we have reason to believe violate local laws or regulations, but we do not assume any obligation to actively monitor or investigate such compliance.
6. Payments and Fees
Promotional Services
Livuma charges fees for value-added promotional servicesโsuch as sponsored placement, highlighted listings, or advertising packages. The price and duration of each promotional option will be shown clearly before you purchase.
Direct Booking Fees
For direct bookings made through our platform, Livuma charges a service commission deducted from the host's payout. The price shown to guests is the full rental price โ no additional service fee is charged on top of the listing price displayed to guests.
Host Commission: A percentage-based commission deducted from the host's payout. The exact rate is displayed in the host's account dashboard and confirmed before each payout.
The exact fee amounts will be clearly displayed before you confirm a booking. Fees are calculated based on the total booking amount and are non-refundable except as required by law or as specified in our cancellation policy.
Payment Processing
Payments are processed securely via our payment service provider, Xendit. By completing a payment, you agree to the terms of service and privacy policies of the applicable payment processor. We do not store your full payment card detailsโall sensitive payment card information is processed directly by Xendit. Guest payments are received into Livuma's account and held until the applicable payout conditions are met.
Escrow and Payment Holding
For direct bookings, Livuma holds guest payments in an escrow-like arrangement. Your payment is held securely until guest check-in, at which point payout (minus the platform fee) is released to the host's Indonesian bank account according to our payout schedule. In the event of a cancellation or dispute, funds may be held longer until resolution.
7. Direct Booking Terms
Booking Process
When you make a direct booking through our platform:
You must complete identity verification (KYC) before your booking is confirmed
Full payment is required at the time of booking
Your booking is confirmed once payment is successfully processed
Both guest and host will receive booking confirmation details
Identity Verification (KYC)
To ensure platform safety and comply with legal requirements, guests making direct bookings must complete identity verification through our KYC provider (Didit). You may be required to provide:
Government-issued identification (passport, national ID, driver's license)
Selfie photos or live video for biometric verification
If you fail to complete KYC verification or your verification is rejected, your booking may be cancelled and refunded (excluding platform service fees, which already include payment processing costs). You agree that your identity information may be shared with our KYC providers and stored in accordance with applicable anti-money laundering and counter-terrorism financing regulations.
Host Payout Schedule
Hosts will receive payouts (booking amount minus platform fees) according to our payout schedule:
Standard bookings: Payouts are released to hosts after guest check-in, subject to platform rules and verification
Cancelled bookings: Refunds processed according to applicable policies, host payouts adjusted accordingly
Hosts must provide valid payment account information and complete verification to receive payouts
Payout timing may vary based on payment processor requirements and verification processes
Extended Payout Holds
Payouts may be delayed or temporarily held in the following circumstances:
Suspected fraud or suspicious activity requiring investigation
Active disputes, chargebacks, or guest complaints
Compliance review or verification requirements
Payment service provider holds or requirements
Legal requests or regulatory requirements
Cancellation and Refunds
Cancellation policies are set by hosts and specified in each listing. Before booking, guests should carefully review the cancellation policy applicable to their booking. Our platform supports flexible, moderate, and strict cancellation policies.
In certain circumstances, we may override a host's cancellation policy and provide refunds of eligible amounts (excluding platform service fees, which already include payment processing costs), such as when:
A host cancels a confirmed booking (refund of eligible amounts, excluding platform service fees)
A property is not as described or is unsafe (refund of eligible amounts, excluding platform service fees)
Extenuating circumstances prevent a guest from staying (refund amount determined case-by-case)
A guest is unable to complete KYC verification (refund of eligible amounts, excluding platform service fees)
Refunds are processed to the original payment method within 5-10 business days after approval. Platform service fees are generally not refunded except in cases of host cancellation or platform error.
Payment Disputes and Chargebacks
If you initiate a chargeback or dispute with your payment provider, we reserve the right to suspend your account pending resolution. Host payouts may be delayed or withheld during dispute resolution. We encourage users to contact us directly to resolve issues before initiating chargebacks.
Chargeback Recovery: In the event of a chargeback or refund, Livuma may recover the disputed amount by deducting it from the host's current or future payouts. If a host's payout balance is insufficient, this may result in a negative balance that must be settled before future payouts are released.
Host Tax Responsibility
Hosts are solely responsible for determining, reporting, and paying all applicable taxes related to their rental income, including but not limited to income tax, hotel/accommodation tax, withholding tax, and any other local or national taxes. Livuma does not act as a tax agent, withhold taxes on behalf of hosts, or provide tax advice, unless explicitly required by applicable law.
Data Sharing
By using our booking and payment services, you consent to the sharing of your booking information, identity verification data, and payment details with our payment service providers, KYC verification vendors, and fraud prevention services as necessary to process bookings, verify identity, prevent fraud, comply with legal requirements, and resolve disputes.
8. Refunds for Promotional Services
Promotional fees (for sponsored listings, highlighted placements, etc.) are non-refundable once the promotion period has begun, except where required by mandatory law. If you cancel a promotional service before it begins, you may be eligible for a refund minus any processing fees.
9. Intellectual Property Rights
The Platform and its original content, features, and functionality are owned by Livuma and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
By posting content on our Platform, you grant us a non-exclusive, worldwide, royalty-free license to use, modify, reproduce, and distribute that content for the purpose of operating and promoting the Platform.
10. Limitation of Liability
To the maximum extent permitted by law, Livuma, its directors, employees, partners, agents, suppliers, or affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
Your access to or use of or inability to access or use the Platform
Any conduct or content of any third party on the Platform
Any content obtained from the Platform
Unauthorized access, use, or alteration of your transmissions or content
Transactions between hosts and guests, including housing quality or safety
11. Indemnification
You agree to defend, indemnify, and hold harmless Livuma, its directors, employees, partners, agents, suppliers, or affiliates from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Platform, your violation of these Terms, or your violation of any third-party rights.
12. Dispute Resolution
If a dispute arises between you and Livuma, we encourage you to first contact us directly to seek a resolution. If we cannot resolve the dispute informally, these Terms shall be governed by and construed in accordance with the laws of the Republic of Indonesia. The District Court of Denpasar (Pengadilan Negeri Denpasar), Bali, Indonesia shall have jurisdiction, without prejudice to mandatory consumer protection rights under applicable Indonesian law, EU consumer protection law (for users resident in the European Economic Area), or other mandatory consumer protection rights under the law of your country of residence that cannot be excluded by contract.
13. Termination
We may terminate or suspend your account and bar access to the Platform immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including but not limited to a breach of the Terms.
If you wish to terminate your account, you may simply discontinue using the Platform or contact us to request account deletion. All provisions of the Terms which by their nature should survive termination shall survive, including without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Governing Law
These Terms and any dispute arising out of or in connection with them are governed by the laws of the Republic of Indonesia. The District Court of Denpasar (Pengadilan Negeri Denpasar), Bali, Indonesia shall have jurisdiction, without prejudice to mandatory consumer protection rights under applicable Indonesian law, EU consumer protection law (for EEA residents), or other mandatory consumer protection rights under the law of your country of residence that cannot be excluded by contract.
